Terms of Use

1. Who provides the service

School Exams is a platform for conducting school exams, available at school-exams.com. It is provided by «ФИРМА», UIC «ЕИК», with registered seat and address of management «седалище и адрес на управление», represented by «представляващ».

In the text below, “we” means the company, “the platform” means the service, and “the school” means the educational institution that takes out a subscription.

2. What the service is

The platform allows the school to create question banks, compile tests, schedule and conduct exams, grade them and keep their results and history by school year.

Access is through a web application and through applications for desktop and mobile devices. Different roles are used — school administrator, teacher and student — with different rights.

The service is provided as described on this website at the time the subscription is concluded. We develop it and add features; we do not materially reduce the agreed scope within a paid period.

3. Who may use it

The customer under the contract is the school, not the individual teacher or student. Teachers and students get access through registration codes issued by the school.

The school is responsible for who gets access, with what role and until when. It can withdraw access at any time from the administrator panel.

Students use the platform within the educational process organised by the school. The relationship between the student and the school is governed by the school, not by us.

4. Concluding the subscription

The subscription is concluded in writing between us and the school. A Data Processing Agreement governing the processing of personal data is signed together with it.

The demonstration before signing is free of charge and binds neither party.

There is no trial period. The demonstration is detailed enough for the school to judge whether the platform meets its needs.

5. Prices and payment

The price depends only on the number of students, the number of teachers and the disk space per teacher. The formula and the current values are published on the pricing page.

Payment is annual and is made before the start of the school year. When starting in the middle of the year, the price is calculated pro rata.

The number of exams, questions and attached files is not charged separately.

The limits are set by the numbers of students, teachers and disk space agreed at signing. If they are exceeded, a new price is calculated and a supplementary agreement is signed. We do not stop exams in the middle of the school year because a limit has been exceeded.

Additional services — online or on-site training, priority support and others — are paid separately at the prices published on the pricing page or agreed in writing.

6. Obligations of the school

— to use the platform for its intended purpose and in accordance with the law;

— to keep registration codes and access credentials safe and to withdraw them promptly when an employee or student leaves;

— to enter accurate data about its teachers and students;

— to inform students and their parents about the use of the platform, insofar as this is its obligation as controller of personal data;

— not to attempt to circumvent technical limitations, overload the service or gain access to another school’s data.

7. The content remains the school’s

Questions, tests, teaching materials, student answers and grades are content of the school and its teachers. We acquire no rights in them.

We do not use the school’s content for our own purposes — neither for training models, nor for analysis beyond providing the service — and we do not make it available to third parties.

The software, the interface, the documentation and the platform’s brand remain our property. The subscription grants a right of use; it does not transfer any rights in them.

8. Availability and support

We aim for the service to be available continuously, but we do not guarantee uninterrupted operation. Planned maintenance is announced in advance and scheduled outside exam periods as far as possible.

Support answers by email within 24 hours on business days at support@school-exams.com. Priority support with a shorter response time is agreed separately.

If an exam is interrupted for a reason attributable to us, we assist in restoring it. Student answers are saved automatically on the device and synchronised when the connection is restored.

9. Liability

We are liable for damage caused by our non-performance up to the amount paid by the school for the current school year.

We are not liable for: consequences of inaccurate data entered by the school; actions of teachers or students; interruptions of the internet connection of the school or its devices; loss of access due to lost or shared credentials.

None of the limitations in this section excludes liability that cannot be excluded by law.

10. Term, termination and data afterwards

The subscription is for one school year and is renewed by agreement.

Either party may terminate the contract in the event of material non-performance by the other, after written notice and a reasonable period to remedy it.

After termination the school can download its data in a machine-readable format. After the period agreed in the Data Processing Agreement expires, the data is deleted or returned, at the school’s choice.

11. Changes to the terms

We may change these terms. For material changes we notify the school in writing at least 30 days in advance.

If the school does not accept the change, it may terminate the contract before the change takes effect; in that case we refund the amount paid for the unused period.

12. Governing law and disputes

These terms are governed by Bulgarian law.

Disputes are resolved through negotiation and, failing agreement, by the competent Bulgarian court.
